Whether we’re supporting you through search & selection, secondment, temp-to-perm or freelance mediation, this document outlines the basic principles and legal framework behind our services.

Scope of Application

These Terms & Conditions apply to all recruitment services provided by Capri Partners B.V. (“Capri”), including but not limited to:
• Search & Selection (Direct Placement)
• Secondment (Temporary Employment)
• Temp-to-Perm (Temporary to Permanent placements)
• Freelance Mediation (Intermediation of self-employed professionals)
• By using our website or entering into a business agreement with Capri, you agree to be bound by these Terms.

Definitions

• Client: any organisation that enters into an agreement with Capri for recruitment services.
• Candidate: any person introduced by Capri to a client for potential engagement.
• Freelancer: a self-employed professional introduced via Capri.
• Assignment: the scope of work for which Capri delivers services. .

Recruitment Services Overview

Capri Partners offers full-service recruitment support in various forms:
• Search & Selection: Capri introduces candidates for permanent employment. Capri is not the employer and solely acts as an intermediary.
• Secondment: The candidate is employed by Capri and temporarily assigned to a client.
• Temp-to-Perm: The candidate is employed by Capri with the intention or option to be permanently employed by the client.
• Freelance Mediation: Capri facilitates freelance assignments and acts as intermediary in contracting and invoicing.

Each of these services may be subject to additional agreements or framework contracts.

Liability

Capri is not liable for any damages, direct or indirect, arising from the acts or omissions of candidates once engaged by the client, unless due to gross negligence or intent on the part of Capri.

Confidentiality

All information shared between Capri, the client, and candidates is confidential and may not be disclosed to third parties without prior written consent.

Intellectual Property

All content on this website and in our communication, including texts, tools, templates and methodologies, remain the intellectual property of Capri unless otherwise stated.

Data Protection & Privacy

Capri processes personal data in line with the Privacy Policy and applicable data protection laws (e.g. GDPR). Clients and candidates are responsible for complying with data privacy obligations on their end.

Applicable Law and Disputes

Dutch law applies to these terms. Any dispute shall be submitted to the competent court in Amsterdam, the Netherlands.

These Terms & Conditions are governed by the laws of the Netherlands and Belgium, depending on which Capri Partners entity is providing the service:
• If the agreement is concluded with Capri Partners B.V. (Netherlands), Dutch law applies, and any disputes shall be submitted to the competent court in Amsterdam, the Netherlands.
• If the agreement is concluded with Capri Partners Belgie BV (Belgium), Belgian law applies, and any disputes shall be submitted to the competent court in Antwerp, Belgium.
In the event of ambiguity, the entity named in the service agreement or invoice shall determine the applicable law and jurisdiction.
